Effective immediately, C.A.R. withdraws forms DRE-AFL (Advance Fee Agreement for Loan Modifications Services), DRE-AFVA (Verified Accounting for Advance Fee) and DRE-AFI (Advance Fee Agreement Instructions). 

 

On October 11, 2009, a new law (SB 94) (http://www.leginfo.ca.gov/pub/09-10/bill/sen/sb_0051-0100/sb_94_bill_20091011_chaptered.html) came in to effect prohibiting anyone from claiming any compensation for negotiating or arranging a loan modification, in connection with a loan on residential property improved with one-to-four units, until after that person fully performs each and every service as promised.  Accordingly, as of that date, advance fee agreements are not permitted for loan modifications for residential properties.  Aimed at combating loan modification scams, this ban applies to upfront fees collected by real estate agents and others.  Violations can be penalized by, among other things, a $10,000 fine plus one-year imprisonment for individuals, a $50,000 fine for businesses, and loss of license.  Even if a real estate broker has already had an existing Advance Fee Loan Modification Agreements reviewed by the Department of Real Estate (DRE), as of October 11, 2009, the broker can no longer use those agreements or collect advance fees based on those agreements.  For the more information, see the DRE announcement at http://www.dre.ca.gov/pdf_docs/SB94WebAnnouncement(brokers).pdf
